Part (1):

“Active argues that the summary judgment motion should be denied pursuant to CPLR 3212(f) without any indication of the basis for such relief”

Part (2):

Without any pertinent precedential support, Active argues that the holding in Unitrin should no longer be followed”

Yet, Mr. Active, his cousin Chuck Deng acupuncture and Jean Claude Compas will continue to make the same arguments, and kill more trees while doing it.
